You can claim the son only if he is truly your dependent. If she plans on claiming him then, no. If you claim him, and she claims him or his father claims him,you will be in big trouble with with IRS.

And you cannot claim any adult as a dependent unless they are disabled.

You can claim your gf if your gf

1. Lived with you all year (not in violation of local laws)
2. Had income less than $3,500 subject to tax
3. You provided over half of the person's support

You can claim your gf's child in two cases:

A. The child is your son: You can claim the child and receive all tax benefits.

B. The child is not your son: You can claim the child if

1. A parent does not claim the child
2. The three conditions above listed for the gf are also true for the child
3. The gf does is not required to file a tax return, and if she does file a tax return, she does so only to get a refund of tax withheld.

Now if all that is true under case B, you get an exemption of $3,500 for the child, but no EIC, no Child Tax Credit, no Head of Household designation.

Depends.
Does she have more than $3500 income during year? Did you live together ALL year? Are either of you married to some one else? Does your cohabitation violate any local or state laws? Did you support both of them?

If you get married before year-end, you file a joint return, you, her, and claim her son as dependent.

MOST of the above postings are WRONG, because there are circumstances where you can claim both of them as dependents, but not enough info is provided.

does she work? will she be filling also? do you support them both for more then 6 months out of the year(living in the same house hold doesn't really matter)? Keep in mind if she is working, she will be filling as well and i'm pretty sure she will be claiming her son. But if she doesn't work and you have her permission you can claim them both as long as you have been supporting them for at least 6 months out of the year. Also you might need proof for any reason they audit you. call HR block and just ask, i'm sure they will let you know.

It depends. If you have provided more than half of her support for the year, and she lives with you then I would say yes. I would suggest you go to the IRS website, and look up what they consider to be a dependent.

i think it really depends on whether or not they live with you and you would need to be able to make a reasonable claim that you help support them

Unfortunately, no you cannot claim either of them on your taxes. Only if you are married or if the child is yours can you claim them on your return. You will still have to file single and she will have to file Head of Household, since she can take her child.

i think u can if ya live together for six months and if she dont claim any taxes...or just call ur tax agent and ask.
