Claim your nephew, maybe. Did you provide his support for his whole couple of days of life? Where's his mother or father - they would usually claim him and have a higher right than you do based on the relationship? This is a question for a professional tax preparer, other than H&R Block - they won't know this answer.
Don't listen to most of the people above. You don't have to support him for a whole year becasue he wasn't alive yet - dumb! You don't have to be his "legal guardian" either. |

You can only claim him if he lives with you and you support him, and his mother or father are not claiming him. As for how much depends on how much you made, paid in, etc |

Like the others say, unless he's a "dependent", I would tend to think that you wouldn't be able to claim your nephew on your taxes. I would ask for tax help, though -- some people can get free tax advice (poor, elderly, disabled, veterans, whatever.) |

If he was born anytime is 2006, he can be claimed as a dependent for 2006 assuming he meets all the other tests. Your question does not contain enough information to determine if he is YOUR dependent. You do need a SSN for him BEFORE you file. |

If he has lived with you since he was born except for time in the hospital (OK, given that he arrived on 12/28, that wouldn't be much time), and neither of his biological parents also lives there, then you MIGHT be able to. But if a parent lives there also, then no. |
