Can i claim my partners children on my taxes?
my partner and i have been together for 9 years in Virginia. She has 2 kids and i have one. All children live with us. Up until this point we have both filed taxes seperately. For the year 2007, she did not work. I supported her and her kids. No one else claims her children on taxes. She will not be filing at all this year due to not working. The question is: Can i claim her children on my taxes since we all lived together and i supplied all the support?

To claim a person other than a relative as a dependent, you have to meet certain additional conditions:
First, the person has to have lived with you for the entire year (certain relatives don't have to meet this test).
Second, the relationship cannot violate local law (this would not apply to a relative).
Third, that person's gross income must be less than $3,200. Fourth, you must provide more than one-half of that person's total support for the year (such as the value of lodging, food, insurance and the like).
You cannot claim head of household filing status. Head of household status applies only when the member of the household is a relative. You will have to claim single.

Yes you can. Before my husband and I got married we lived together and he claimed my son on his taxes for a few years. As long as you are living in the same household for at least 6 months out of that year it is ok.

The federal government changed the uniform defination of a child. This year you can claim your girlfriend if she didn't work or only files a return to get money she paid in. Which makes her a non tax payer. Then since the children of hers have no one to claim them and you provided all their support it goes to you. You can also amend 2006 to reflect these changes.

Ask a tax service. There are ways to claim children that are of no relation to you but i dont want to guess so call a tax service please. Dont make a mistake on your taxes by relying on someone in yahoo answers.

Let's make this clearer.

If you can claim the girlfriend as a depedent, then she is deemed not have dependents of her own. You then apply the qualifying relative rules to her children.

Under the QR rules, you get $3400 for each exemption. You do NOT get the child tax credit or EIC for her children.
