You sure can if you don't mind being penalized.
My husband did this several times, prior to us getting together, when so many people were doing it. The IRS sent him the check, he cashed it, and then got a letter letting him know that he had frauded the IRS. As a result, he had to pay back thousands of dollars, which carried over when we got married. However, when we had our daughter, we went through HELL and HOT WATER proving that this was his child. He was blessed that he had hit the 10 year mark, when we were trying to claim her for EIC.
Bottom line, if you use a child that is not yours, the IRS may not let you know right off that they are on to you, but when they do...your account is flagged and you are banned from getting EIC for 10 years. This is a long time, and not worth it.
Do the right thing and pay if you owe back, and don't get caught up in the scam that your friends are doing. What's done in the dark will come to light! |

Unless you can prove that you provided 51% of the childs care for the year, then dont claim it. It is illegal, if you are just doing it for the refund purpose. Even if you are giving the money to the parent of the child. It is tax fraud. Yea, people do it all the time, and few get caught but if the IRS ever finds out, you can get fined big time and possibly even have to do jail time.
My ex was gonna let me claim his daughter one time, because i made more than he did one year but i didnt do it. If her jealous mother ever found out, i didnt want to risk her turning me in. |

No! You can only claim for children who are in your legal care, and you are their supporter. Just because the others haven't been caught yet, doesn't mean they won't. if you do it, and get caught, you risk a heavy fine, a criminal record, and possibly jail. |

Oh, right, let's do, get caught and a) get banned from EIC for 10 years for fraud and b) have to pay $4000 back to the IRS for back taxes, penalties, interest etc. It's a vicious cycle once you are caught.
The IRS routinely holds the refund until you supply all of the requested information showing you met the relationship test (oh, darn, you don't have a birth certificate for your brand new relative or marriage certificates showing you are related to the mother or father) or the residency test (hm, 1 bedroom apartment, where do they sleep?) When it becomes clear that you could NEVER have qualified for EIC, you get banned.
Then when you DO have kids of your own that you can claim, oh, darn, it can't get the money.
And all it takes is one return to unravel. It could be your return for this year, last year, next year, the parent's return that suddenly doesn't list this dependent, any return prepared by the same bad preparer and you'll get caught. For fraud, there is no statute so all tax returns that you've ever filed are up for grabs. |

So let me understand this. You want to cheat the IRS. So you post online about doing so? Lovely bunch of people you work with there. I'll be sure to forward the link to this post to my buddies at the IRS!
And PS: if you do still do it they probably won't catch you right away. But they WILL catch you - years from now when it's fines, penalties and interest up the ***. Do you really think that's worth it? Plus you know what? If you cheat you're cheating all of us HONEST taxpayers. |
