Can i claim this dependent??
my 25 yr old son lives with me and he worked and made $6000 he filed income tax form 1040A to get back a refund, can i still claim him on my taxes as a dependent as i provide more than 50% of his living costs for the year....can i file Head of Household or do i have to file single ???? thanks for help

Not sure where everyone is getting their info...

You can only claim your children as dependents until they reach age 19...age 24 if they remain full-time students. If your son turned 25 in 2007, you're out of luck, unfortunately. The only time after that parents can claim their children is if the child is permanently and totally disabled.

From the IRS website -
Example 1 -
Your unmarried son lived with you all year and was 18 years old at the end of the year. He did not provide more than half of his own support and does not meet the tests to be a qualifying child of anyone else. As a result, he is your qualifying child (see Qualifying Child, later) and, because he is single, is a qualifying person for you to claim head of household filing status.

Example 2—child who is not qualifying person.
The facts are the same as in Example 1 except your son was 25 years old at the end of the year and his gross income was $5,000. Because he does not meet the age test (explained later under Qualifying Child), your son is not your qualifying child. Because he does not meet the gross income test (explained later under Qualifying Relative), he is not your qualifying relative. As a result, he is not your qualifying person for head of household purposes.

You'll have to file Single...sorry.

I'm not certain with all the technicalities, but if he claimed himself (ie. he didn't check the "Claimed on someone else return" box) you can't claim him.

No unless you have a good paper trail. But you could start writing him checks if he borrows a lot. And then anything over 500.00 you can 1099 & 1096 him next year. That is income and you paid it out if he signs the check it is income. This worked wonders for my kids and they quit reling on me to suplament their income. If he got money back he claimed his self as a deduction. But if you do go this route make sure he is aware because he will have to pay taxes on that money.

If he made less than $3,400 and you provided more than half his support, then you could claim him...

No he doesn't qualify. He's too old to be your qualifying child (under 19 or under 24 and full time student) so then you look to see if he's a qualifying relative (he must make less than $3400 to qualify). So you're out of luck. Nevermind that he already filed himself and took his own exemption. Head of Household requires a dependent which we've just determined you don't have, so your filing status will be single.

Yes you can claim him if you supported him for 70% of the year, and I would state head of household.

well since your son allready filed his taxes, you first have to see if he claimed his own personal exemption or not. if he already filed his own exemption then you can not claim him, and i assume if you are not married then you will file single.

if you have provided 51% of his living cost for the year and you can provided that information in form of paperwork then yes you can claim him and you can claim himhead of household
