Can i file as head of household for 2008?
My girlfriend and i live together with our 15 month old. I pay over half of the bills but i am not claiming my daughter as a dependent. My girlfriend will since she makes less then me. Does my daughter still count as a qualifying child?

IRS does not look kindly on folks trying to abuse the EIC. You can't both be Head of Household claiming the same child. If she claims your daughter, you can't claim her or your daughter. If you are married and live together, one can't file HOH claiming the child and the other single.

From the IRS website:
Some of the most common reasons for EIC disallowance are:
Claiming a child who is not your qualifying child.
Married taxpayers who should file as “married filing separately,” file as single or head of household instead.
Income reported inaccurately.

If you live with a man who makes 100K per year while you make 15K and you have a child together and he files single and you file HOH and claim the EIC, you could be in trouble with IRS if audited. There is a lot of fraud in the EIC program.
It was designed to help the working poor, not to create a way to scam the government.

You girlfriend can claim her child. If you were married you would have to file married filing jointly in order to get the earned income credit.

You would only be able to file as Head of Household if you claim your daughter. If your gf claims her, you'd file as single, assuming that you are. You can't get BOTH benefits, although you can choose.

No, you can not file as HoH. To file as HoH, you must also claim your daughter on your tax return since you and the mother live in the same household.

In your situation either of you can claim the child. You should figure it both ways to see which way works out best. You as HoH and claiming the child with her as Single or both as Single with her claiming the child and (presumably) the EIC.

Not sure where "exirsman" get's his info from but you don't add household income to figure the EIC unless you are married and filing a joint return. It's never added when 2 singles live together and both can qualify for it in their own right if otherwise eligible.

Only 1 person can claim the dependent. You must have a child to claim to be head of household. You should do taxes both ways to see which way it comes out better. How much is her income?

Only one person c an claim the child as head of household...generally it is the person who provides greater than 50% support. You should run both returns and file the most favorable to both of you.

I have been a single parent before and FYI you would have to claim your daughter and her Socal Security Number as a dependent in order to file as HEAD OF HOUSEHOLD...and the other person would file a Single return, or vice versa but you both cannot claim your daughter

Hope the Above Info Helps bec the Rules are very clear in IRS Publication 17!

yes, you can claim head of household. I claim it every year, but only claim my son as a dependent every other year.
