Can i file for taxes if i work "Off the books" " Under the table"?
Im 21 years old and i have a 1 year old baby, This year i work "off the books" As a cashier at a local Supermarket, I also went to school Full time, Can i file for taxes this year, I made a total of $13,282 So far and i have paid for daycare ($2,300) so far, What can i do, should i request a letter or something, Help!

Yes, you need to file. However, you may have to fill out an SS-8 to get IRS determination of your employment status. This may result in your employer getting very upset. If IRS determines you are an employee then your OK. If you file as self-employed, you would owe social security.

Based on $13K and a child, if Head of Household, you would get a very large refund (Earned Income Credit) of a few grand if determined to be an employee..

You not only can, but legally you are required to. You don't need any paperwork, you just show your earnings on a schedule C-EZ and use a schedule SE to calculate your self employment tax for social security and medicare. The numbers from the bottom of those two schedules transfer to a form 1040, not 1040A or EZ, to calculate your total tax. With the numbers you show in your question, you won't owe any federal income tax, and your self employment tax will be more than wiped out by an Earned Income Credit. You won't get any tax break for the daycare costs - that can only reduce your income tax, and yours will already be zero so there is nothing to reduce.

You do realize that by working "off the books" you aren't covered for workers comp it you get hurt on the job, or for unemployment comp if you get laid off? You'd be wise to find a different job that pays you legally.

Let's see. $13282 so far for 2008.

1. You file a schedule C for the $13,282. That equates to $1876 of self-employment taxes (somebody has to pay this and if your employer won't pay their half, you get to). You can't not file this or you would be an income tax cheat too.

2. Assuming you claim your daughter, your income tax would be probably around $0, even with tax, the day care credit would bring it to zero. You *might* be eligible for $500 from the additional child care credit and some from EIC, but the IRS is going to want to verify that you actually worked and received that income. You won't have a W-2 or paystubs because your liar of a boss has been paying you under the table. He certainly won't sign a letter on company letter head that you worked and got paid that money--that would just guarantee that he gets audited.

If you have faithfully deposited the money into your bank account every time you got paid, you might have a prayer.

If you mean you do not get a W-2, then you would be considered self-employed unless you choose to challenge the company for hiring you as a contractor.

You should report your income on Schedule C and report your child care expense on Form 2441.

Get a copy of Publication 17 at www.irs.gov. You can request a copy or download it. You can also just read what you need to read while online at the irs web site.

If you go to a local CPA he can do it for you. You will probably get an earned income tax credit and a child tax credit also, so an accountant's fee might be well worth the cost.

First, you cannot claim to file as a taxi driver as mentioned above. Taxi drivers are considered independent contractors and file under different rules. You would have to file as an employee. This puts you and your employer in violation of the law. The employer should have withheld taxes, paid into the UI system for you, paid into Social Security and Medicare for you, and paid into workers comp system. Since you worked "off the books" they most likely did none of that. Next, since you worked off the books, you paid no money into the system as required. You will have to pay over 6% of your gross pay (about $800) into the Social Security/Medicare system if you file and then you will have to pay however much in taxes you would normally owe (although you might qualify for a child care tax credit).

The downside of all this, of course, is that none of this work goes toward qualifying you for social security when you turn 65. Also, if it comes to light that you have worked off the books, you could be held liable for unpaid back taxes.

You have kept good records. Good for you! Keep any slips or copies of checks so you can prove what you earned.

When you do your return, report exactly the amount you received. Since you are working as a cashier I doubt you'll have any deductible expenses. You won't need a letter from them and I doubt they will give you one.

File Sch C-EZ and Sch SE to calculate your income tax and self-employment tax. Unless you earn over $15650 you won't owe any income tax. The SE tax will be a little over 13%.

You will get Earned Income Credit which will cover this and still give you a nice refund.

One more tip: There is a new form you can use to pay your 1/2 of the Social Sec. & Medicare taxes instead of filing Sch SE. This will save you significantly but it will point a finger to your employer. Of course, what they are doing (paying you off the books) is totally illegal so they deserve it. You can decide which way you want to file. You also have three years to change your mind and amend your return so you might want to go the SE route now and then amend after you no longer need this job.

No one can give you advices in a public forum on taxes if you openly admit that you do not pay taxes. I would suggest that you restate the question.

You can file your taxes and report it under line 21 as other income. You did not pay taxes so there is no refund. You would at least be clean with the IRS and you may not owe any taxes once you finished your return.

i have claimed taxes that way. if they want you to calculate other expenses less is better. as far as food and mileage. they will first tax your income then they will give you a credit. H&R block.

No, if you were paid off the books you didn't pay taxes so you won't be entitled to a refund. If you file you may get your employer and yourself in trouble, you will also have to pay taxes on what you earned.
