i did some paperwork for my brother in law for his trucking company for a few months this year. he either paid me by check..200.00 or cash when he wrote the check it never said what it was for.
he never put me on payroll because if he did he would've had to pick up workermans comp insurance on me and he never got my social secruity numbers
he's trying to send me a W-2 right now...
Can he? He never had me on payroll and if he wants to state i was his employee , he never got that extra workers comp insurance so wouldn't he be hurting himself?
If he sends a 10-99 doesn't he need my ss#?
he was all set in paying me under the table until a family spat happened.

Based on your info, you acted as a independent contractor. As such, you were a 1099 employee and not a W2 employee. He does not need to 1099 you unless he paid you more than $600 in a single calendar year. He can still write it off on his tax return even if he does not 1099 you. Plus, if he did not ask you for your SS#, and you wont give it to him, their is no way he can 1099 you. Rule number 1, never work for family.

He's obviously being foolish. $200 on a contract basis would not even require a 1099 out of the man. He's out 84 cents in postage fees to you and the feds. And the cost of paper work to fill out the forms on you.
Go ahead and report the $200 on your 1040 as misc income if you wish. It won't amount to much and will be no fur off your behind.
However, if he says you were hired as a W-2 worker, he sure as heck should have included you in EED and Workmen's Comp insurance documents for the time you worked there.
Still, you've got no problem. Obviously he does, and it's not just with the IRS...

absolutly correct. if he gives you a w2 he will be fined, and have to pay all of the fica, comp , unemployment disability etc plus all of the state and federal taxes. and also yes needs a ss# for 1099. but i do believe one is allowed to earn maybe 900$ or some such on a 1099 and not need claim it on your own taxes at years end. that is in now way to include any cash payments. so go through your deposit slipos/ statements and find exactly how much you got in checks just to cover ur as s |

Gee, your brother-in-law was willing to help you commit tax evasion so you could save probably $30-50. And now that he isn't willing to be complicit in your illegal actions, HE's the bad guy. Hmmmmmmm..
He would have a problem sending you a W-2 if he didn't deduct and remit taxes, but he could send a 1099. |

If he does not have your social security number, he cannot file a W-2 for you without that number. $200.00 office help and he was worried about workman's comp? That is silly of him. the rate would have been low anyway.
He can try to send you a W-2 without a social security number. If he paid you by check or by cash, he can still generate the information. He would have to pay the Fica and Medicare regardless.
He can file a form 1099 without a social security number. He is subject to a penalty for not obtaining the number.
If he wants to give you a W-2, he needs to have a W-4 on file stating what your withholdings were to be? He will shoot himself in the foot.
There is a tax form to report that the W-2 was prepared incorrectly which you attach to your return. This will flag him with IRS (IRS form 8919) |

I would agree with firsttx. You seem to be an Independent contractor more than an employee to your brother-in-law. He shouldn't be sending you the W-2. He needs to pay all the taxes associate with W-2 first, which he probably didn't. He could however send you a 1099. |

If he paid you without deducting wages and reporting them, then he shouldn't be doing a W-2. And if he is, he's in way bigger trouble than you are because as an employer, he is held to a higher standard.
