I think you have to prove that you supported them with at least 50% of their support.

You can claim your parents as dependents, but there's some special rules dealing with parents. There are special rules dealing with people who are living with you for whom you're providing over half their support. You need to get into that if you have people who are not just your children. Then it's time back to that tax professional to help you because the laws can get very complex as to who is a dependent when we get beyond the basic child. |

unfortunately the deadline for amending those years have passed, you would have been able to claim them as long as you supported them more then ½ even if they didnt live in your home |

At this point it's too late to get a refund from the years 2000-2003. But unless they had social security numbers or ITINs, you wouldn't have been able to claim them anyway - and there are many other requirements also, which they might or might not have met. |

To file an amended return with refund, you can only go back 3 years, so act quickly.
The other issue is support and the IRS has worksheets you can use to figure out support. |

You need to talk to a CPA, not some tax preparer, but a real tax accountant.
It is possible to file an amended return for previous years, but I don't know how far back you can go. I do not think you can claim people as dependents if they do not live in your home, or if you do not contribute more than half of their income. But, I also didn't know you could claim elderly parents as dependents either.
Make an appointment to see an accountant. He will charge you for the appointment, but it might save you some money. The tax code is far too complicated for you to rely on the advise of anonymous people with unknown credentials on YA.

This would be a question that I would call IRS about. They have a web site at irs.gov that might pertain to your questions. I know that if they lived here in the States that you could claim them but I don't think you can with them being in China. Sorry I couldn't help anymore. |

you would have to amend return; and they would have had to live with you and you provide more than 50% of support.....tough tests to prove this late. I think iyou can only amend 3 years back....sending money to china does not count..... |

You are able to claim them (even now so many years later) ONLY if you didnt file those years otherwise you are NOT able to claim them if you already filed for those years! |
