 Why do people get busted for tax evasion if there is no law that we have to pay income tax?
My understanding is that there is NO law that requires that people pay income tax and yet I hear about people getting popped all the time by the IRS for income tax evasion.

What gives?

Actually, yes! But only to the extent of your winnings. So if during 2006, you win $1,000 and spent $500 in losing tickets, the 1,000 will be claimed as income and the losses are a miscellaneous itemized deduction. So in order to actually get the deduction, you have to: (1) be able to itemize and (2) have enough other misc. itemized deductions to exceed the 2% of AGI threshold. It sucks the way Congress did that, but thats the law. Hope you won big!

No, but any money you earn will be taxable.

Yes you can deduct your gambling losses up to your winnings. However, the income is reported on the front of the tax form as miscellaneous income. The deduction is taken as a miscellaneous decution subject to the 2% floor and you must itemize.

Professional Gamblers, that show profit for the year, can deduct losses. If it's your business, then you could deduct your losses.

That's my understanding from professional gamblers that I knew.

Probably not. But if you're buying copius quantities of them and save them ALL, bring them to the accountant and ask. The worst they can tell you is sorry.
