I got married last year and we both are working. But earlier both of us mentioned as single in our W-4s. So my questions are:
1. Can we file as single now?
2. Will there be any prolblems if we file as single as we are married now?
3. What is the best option to file tax for us?

The IRS requires you to use your marital status on the last day of the tax year for determining your filing status. Since you are married, you have two options, Married Filing Jointly or Married Filing Seperately. Your W-4 does not affect your filing status, just the amount of withholding on your income. Typically, you will be better off if you file as MFJ. |

You may not file as single. You have two options: (1) You can file as Married Filing Jointly (which is the best option) or (2) you can file as Married Filing Separately, which carries the highest rates and penalizes you. |

Your choices are Married Filing Joint and Married Filing Separate. Although you get taxed potentially more as a married couple, you really get hurt (generally) if you go the separate route. |

No, you can't file as single if you were married as of the end of 2007. Filing as single would be illegal. Your best option is to file a joint return. Your only other legal option is married filing separately. |

Yes, you can file single but it probably won't gain you much individually and will most likely hurt more overall. Married couples get tax breaks. A lot depends on how you claim through out the year, if you contribute to an IRA, Roth's and so much more. You may want to learn the deductions rules. The more you can write off your income, the better you will do at tax time. Keep records and do it legal. |
