If your boyfriend is the legal father then yes he can be on the insurance- don't let them deny it. If he is the legal parent. Talk with the state insurance commission. Your boyfriend if he is supporting both of you can claim both- |

Your boyfriend *may* be able to claim both you and your son (from what you say, your b/f isn't the biological father) as a "qualifying relative" which is worth two $3400 exemptions. At the 15% tax rate, that's worth $1020.
Qualifying relatives do NOT make your b/f eligible for HOH (he would still file as single), the child tax credit, the child care credit or EIC. |

Yes, your boyfriend can claim him - you said "our son". If your bf is not your son't biololgical dad, then very different rules apply - your bf can claim him if your son lived with him ALL of 2007, but as a qualifying relative not a qualifying child, which would mean that he could take an exemption for your son but not any credits associated with him like a child tax credit or EIC.
And if he IS the biological dad, then check again on that insurance, he should be able to cover him whether you are married or not. He might have to get some sort of paternity testing done to prove that the child IS his. If he's biologically his, he's legally his. |

I second V P on the answer.
Your boyfriend may be able to claim both of you not just your son. Now, if he is the biological father then that would change things, and then he would be able to claim him as his qualifying child and also qualify for the credits such as child tax credits, dependent care credits, and possibly Earned Income credit. Also change his filing status from single to Head of Household which would give him a higher deduction. |

your child should still be able to be on you BF's health insurance - he's the father - marriage is irrelevant - I'm no longer married and my kids live with my ex and I still cover them on my dental plan - that must be a really crappy insurance plan if they don't allow dependents |

If you boyfriend provides a certain level of income and support for your son (especially if it is also HIS son) and no one else is claiming him, I don't see a problem with him claiming the child.
The key is that no one else claims the child on their taxes. One child, one deduction. |

He can if he works and pays to feed, clothe, shelter, and otherwise take care of your son (and I'm assuming he does). That would make your son his dependent. |
