You can claim an unrelated person as your dependent under the Qualifying Relative rule (yes, I know, it sounds wrong but it isn't) if ALL of the following conditions are met:
1. She is a US citizen or resident.
2. She did not file a joint return with another taxpayer.
3. She is not the Qualifying Child of another taxpayer.
4. She lived in your home ALL year.
5. You provided more than 50% of her entire support for the entire year.
6. She had less than the personal exemption amount ($3,500 for 2008) in gross income, excluding non-taxable Social Security benefits.
7. Your relationship is not illegal under local law, even if such law is unenforced.
If your b/f isn't your daughter's father, he can only claim your daughter if you can not and nobody else has a superior claim, such as the father.
If the 3 of you lived together and your daughter is also his daughter, either of you can claim your daughter regardless of whether he can claim you or not. |

The previous answer outlined the conditions for claiming you on your bf's tax return as a qualifying relative. The situation for your child is different.
Your bf can claim your child on his tax return if all of the conditions for qualifying relative are satisfied, and
1. You, the mother, are not required to file a tax return.
2. If you file a tax return it is only to receive a refund of taxes withheld.
3. The child is not a qualifying child of another person.
4. You have not waived the child's exemption (through IRS Form 8332 or court order) to the child's father.
Any exemption your bf receives for you or your child will not qualify for any tax credit. |
