No, his girlfriend does not count as a "qualifying person" under IRS rules. This is explicitly pointed out in Example 3 of Publication 501 (see link below). |

Do you work? Do you earn more than $3400? Are either of you married to some one else? Does cohabitation violate local laws? Does he support you? Anyone else contribute to household expenses?
He may be able to claim you as a dependent. |

You may want to check this out with the IRS first, but I don't think Co-habiting couples can do that. I think if you are not married, you file single.
Period.
But I could be wrong so call the IRS Hotline and find out for sure. |

Will if he is paying more in the household then he can file for head of the house hold. Like if he pays more for rent, utility, water & sewer, food, etc, then yes he is consider head of the household, but if it is paid equally then no, he shouldn't file for it. |
