They can but you can do something about it because it is a complete rip off.
You can claim back your bank charges for the past 6 years - go to www.moneysavngexpert.com and find out step by step how to go about this. yeah they can, but they have been deemed unfair, however there is a test case going on at the mo and until then, the bank wil not refund any charges.
as for the halifax, heh yeah they are bastards, they dont do same day money transactions. ie if you have a DD going out on a monday and you pay enough in there on a monday to cover it, the DD will not get paid because it has to be in there at least 1 working day before its due to go out ie the friday before.
totals balls if you ask me. I phoned em up and complained and they cancelled the charge there and then but warned me if it happens again then they wont cancel it again.

The answer is....yes they can. We all agree to our banks and building societies terms and regulations but when we don't manage our accounts properly eg not ensuring there are sufficient funds that's when we don't agree with t's n r's! Our bank charged us £28 for being £7 over and once charged us the same figure for being 6p over. It's called "unauthorised borrowing". Credit cards are even worse! you can get charged up to 3 months for going over the limit once! We suggest you either phone your branch manager or make an appointment to go in and discuss the problem face to face. Sometimes they allow it and reimburse you the charges but it depends on the circumstances and whether its something you do on a regular basis. The only way to avoid being charged is making sure you have enough funds in your account at all times.
