Can my dad claim my kids on his taxes?
Me and my kids have lived with my dad the whole year. I didn't work in 2007, so can he claim them? He also calims one other dependent.

I also get child support checks, does this affect anything?

there is no way the childrens father will calim them he has never seen them doenst even know their SSN.

If he pays more then you receive in child support he can claim them unless your ex husband can. Often the ex is allowed to claim 1/2 of the children, especially since you have no income.

There is a form for you to sign to allow your ex to claim even though the children do not live with him. I allow my ex to claim one as he is hte one paying the income tax on hte child support.

But, yes, your children are qualifing relatives to your father.

Yes, your father can claim the children -- and you -- if he provided over half of the support. Compare your income, including the child support, to the total costs for you and your children, including food, housing, utilities, transportation, education, clothing, etc.

The child support counts only in determining whether your father is paying over half of the costs of supporting you all. It is not income for tax purposes, and is never reported on an income tax return.

The father of the children is not eligible to claim any of them unless the decree says he is, and requires you to fill out the Form 8332 and give it to him. Otherwise, you would have to voluntarily give him the form for him to be able to claim one or more of the children as exemptions.

Who gets to take the children as exemptions has no effect on who can take them for Head of Household status or for the Earned Income Credit.

Yes your father can claim them.

You are right, you do not claim your child support payments as income. The father is the one paying income tax on that amount. You only claim spousal support, if you receive it.

Your father can claim the children and receive all tax benefits such as the dependency exemption, child tax credit, and earned income credit.

Child support payments are not support provided by the child. These payments are never taxed and do not figure into the dependency exemption for a qualifying child. For your purpose, they are ignored.

Yes, he can claim them, and if your income for the year (not counting the child support) is under $3400 and he provided over half of your support, he can claim you also.

Yes, he can claim them.. but you both cannot claim them. It's really all up to you if you want him to claim them. If you all have lived with him.. your Dad can claim head of household and still get a tax exemption while you still claim your children. And yes, you do have to report child support checks as "other income". Your children's father can only claim your children if they live with him for more than part of the year.. the person who answered above me is incorrect on that one. Hope this helps.

yes your dad can claim you and your kids as dependents if he has supplied your housing and food for most of the year but if you get child support checks, its possible that the father of the child could claim the child if he wants to.
