no, if someone else is claiming you as a dependent, you can not claim someone as your dependent.. but since your mom is claiming you, she can claim your daughter as well, assuming she is taking care of her as well as you. |

you can not claim eic IF YOU ARE A QUALIFYING child of another person, which you are if your mother claims you as a dependent. |

I'd say not however I'd have your mother do it if she did take care of you both. You can file a mended return if she already filed taxes for this year. Mended returns you can file up to 3 years back. There is a section that states if noone else can claim you...definately I'd check with HR block or IRS... Goodluck |
