Can my employer seize my personal goods?
Is it legal for a company to take your personal property? Example my job doesnt allow cell phones on the work floor. Do they have the right to take away my phone from me? They tried to do that the other day but I refused and said I didnt feel comfortable doing so. So they suspended me for the day? Anyone know if thats legal?

Were they offering to return it to you at the end of the work day? If so, you had the option of surrendering it to them for safekeeping or returning it to your auto (assuming you drove).

Sine you refused to surrender the phone or remove it from the premises and you were thus knowingly breaking a work rule, they had every right to suspend you.

Your job must hire a lot of young people--that's the only explanation I've got for you being treated like a child.

You knew that cell phones were not allowed and you decided to brake company policy. You should have been suspended. You did not say what type of work you do but cell phones can disrupt the work place when they ring and could cause someone to get hurt. The company offer to take the cell phone could be viewed as the company making an effort not to suspend you causing you to lose a days pay. If you do not like the company rules you always have the choice to find another job.

Is it in the policy hand book? If they state that they will do that if the rule of no cell phones is broken than it is not. You would be braking company policy in that case.. If they are going to return it I don't know if it is illegal. I guess you would have to check with a lawyer on that. You could always threaten a law suit though..you might loose your job too. How big of a deal do you want to make this? Pick your battles I guess. I don't agree with them taking personal property though! Bull S---

I don't think it's legal to seize personal property on the job site. Best bet is to consult your employee handbook and read the policy regarding phone usage and personal time.
Also, you might have a case of "retaliatory action" which is illegal in most cases. Managers are prohibited from taking any retaliatory action against an employee not based on company policy. If there is no handbook or written policy then you cannot be held responsible for violation.
Generally, if an employee is in violation of a policy, there should be a series of "disciplinary" actions taken in increasing degrees of consequence..usually starting with verbal, then written warnings..of course leading up to termination of employment.
If this is a family owned (non corporate) business, they can do as they wish because you employment is at-will based.
It is illegal in the corporate based company for an employee to be suspended on site for an infraction that does not prove to be immediately dangerous to other employees or customers.
I would contact your human resources department with this concern.
See if you have violated any known company policy with your cell phone use. If you have had prior issues with cell phone use on company time, and have been warned, then you also need to go back and see if your suspension was warranted.
I seriously doubt not surrendering your cell phone constitutes a violation of any company policy...but misuse of company time might.
