So I worked for a day this week at my new job for five hours at $8/hr. Payday was yesterday and I got my pay in cash. My question is, can my employer remove tax from my pay if he's giving it to me in cash? Because I only ended up getting $30 cash, but if I worked five hours at $8/hr then that should have been $40 without tax. |

Your employer must withhold tax, no matter how you are paid. It is not even optional. It is illegal for your employer to pay you, in any way, without withholding tax. |

Yes, it's legal to pay in cash rather than a check, and the employer is still legally required to withhold tax and remit it to the proper taxing authority. If you didn't get anything to show how much was withheld for what, though, chances are he's playing games and just putting it in his own pocket, and if he took out an even 25% or $10, he's probably not legit - withholding usually doesn't come out that even, and 25% would be high anyway for an $8 an hour job. |

Not only can your employer withhold taxes, if you are an employee your employer is required to withhold taxes regardless of the method of payment used. However, withholding $10 from $40 in pay is rather high (unless you requested an additional amount withheld or there is a withholding for something other than taxes). I would recommend you ask your employer for a detailed accounting of how much was withheld for what purpose. |
