Can my ex husband claim our kids for income tax even though they live with me?
My ex husband is trying to claim our 2 kids. They live with me, he barely sees them and he only gives them $50 a week total. Some weeks he claims "I'm broke so I can't give them any money". I feel that he shouldn't have the right to claim them. He said that he got a lawyer. Does he have the right to claim them even though I pay more than 80% of their cost of living? Jss has a good answer, but to elaborate a bit more on the custodial parent: As having the children living with you, you can take into account all monies that you spend for food, rent, heating, cooling, clothes, electric, water, sewage etc..etc..etc that you spend. If he gives only $200 a month, which would be $2400 a year, you by far would be paying more than he does...consult a lawyer, bringing your monthly outcome for upkeep to verify your claim...then if your ex brings you to court, get a lawyer and make sure that ex pays for court costs and the cost of your lawyer. Dead beat dads are a plenty...$200 a month is not even close to what it costs to raise two children...he's a bum, good that you got rid of him......another good thing is to check your divorce papers.....if by some chance it states whom can claim the children..you may have a problem...but that can be amended especially if you show your monthly bills that support your children.

No. The custodial parent claims the children as dependents. Let him do it and the IRS will be on his case very quickly.They will pick up that two filers are claiming the same children by their social security numbers. Let him tangle with the IRS and he will not have time to harass you

Only the custodial parent can claim the child.

It depends on your divorce decree. If it is silent about the deductions, the custodial parent generally gets the deduction under IRS regulations. If the decree orders otherwise, then it controls, but the IRS requires you to sign a form authorizing it and if you don't, your ex could take you back to court. You can ask that the decree be modified if it gives him a deduction.

You have to be careful..what does the divorce decree say? Who provides more than 50% support? And do you have an agreement with your ex as to who can claim the children. If you both claim them, the IRS will reject one or both of the returns.

check your divorce decree, does it state that you switch years on claiming the children as dependents? If it does then he has the right to claim them, however, if it does not then whoever the children reside with is the person that has the right to claim them.

My niece and sister live with me, my sister was out of work for over 8 months and her ex-husband was not paying child support during that time so the care of my niece fell on me. I claimed my niece last year on my taxes because I was her primary care giver and she lived with me more than 6 months out of the year as per my accountant.

If it does not state that he has the right to claim the children every other year then no he doesn't not have the right to claim them as dependents, if the IRS investigates he cannot prove they live with him, you can, just like I could.

He can claim any money he gives you for them.
But he cannot claim them as dependents since they don't life with him.
If you want more money go to the district attorney and file paperwork to get him to give you more.
