Can my fiance file my child on his taxes?
I was wondering if my fiance could claim my child on his taxes? His mother told us we could, but I just want some other answers to make sure. I didn't work this year at all stayed home had a baby. So since I am not filing she said that he could claim my child (which isn't his child). We have lived together for 3years he has two jobs all that stuff. Can it be done that way? Thank you so much!!

Yes he supported all of us more. And the father of the child want ever claim him so nothing to worry about there. And we lived together more than a year.

Yes. As long as your child lived with him for the entire year, he provided more than half of the child's support, and the child doesn't make any (or at least not much) money of his or her own, then you're probably fine. The biological father can't claim the child, though, if your fiancé does, so make sure that's the case.

From the information you've given, he'll probably be fine to claim the child. Just make sure he meets the requirements to the letter. If you want more specifics, go here:

he can claim the child as a dependant and use him for the exemption, but he cant get the benefits on earned income credit. there would have to be an actual legal relationship to be able to claim that. he also doesnt qualify for the child tax credit or the additional child tax credit. the irs is very strict when it comes to claiming children and establishing if a child has a legal relationship with the taxpayer.

He can claim both of you because he provided over half of your support. However, he will not get the earned income credit for the child since it is not his child. He will benefit as far as using the child as an exemption to offset taxes

If you didn't have gross income over $3500, and the baby lived with him ALL year, or at least since he or she was born, and he provided over half of the baby's support, then yes he can claim the exemption for the child. But he would not qualify to get any credits for the child like the child tax credit or EIC, and can't file as head of household.

If you can be claimed as a dependent, then you can't have dependents of your own.

If you, the child and your fiance lived together all year (without any of your relatives), if you and the child each made less than $3500, he provided more than half of your support, then yes, he can claim the two of you as "qualifying relatives." This gives hime the $3500 exemption ONLY. No HOH. No EIC. No child cre. No child tax credit.

If your mother lived with you and she *isn't* a dependent, then she's the only person who can claim the child. He is her qualifying child--and the first prerequisite for qualifying relative that the child is NOT a qualifying child for anyone else.

Your fiance can claim you son as his dependent. He can also claim you as his dependent. Your fiance cannot, however, file as head of household nor claim EIC.

This assumes both of you lived with him all 12 months of the year, he provided more than 50% of your and your baby's support, and neither you nor your baby had more than $3500 of income.

Child is not a qualifying child of your fiance.
Child can be his qualifying relative is:
1. Child lived with your fiance for all the year, and
2. he provided more than half of his support.

Whoever supports that child takes the child as the dependant, whether or not the child is the biological child of that taxpayer.

If your fiance supported both of you, he should take BOTH of you as dependents, not just your child.
