Yes, Your oldest is his dependent!!! He lived with him more than 6 months out of the year and provides him support financially. If your oldest sons father claims his son it is fraud and he could go to jail.
I will be claiming my step daughter when we get married. Until then we each claim 1 child. She lives under my roof and I bring home 70% of the income. It's only right that I can claim her.
Go for it you and your husband have the right. Since you are probably filing jointly it really doesnt matter then since your name will be on the return as well. |

It would make sense for you and your husband to file a joint return, and claim both of your children on that - you'll pay less in tax that way. You can file jointly even if all the income was made by one of you.
Even if their father was paying child support as ordered, you and/or your new spouse could claim your son since he lives with you - the only way his father could claim him is if you signed a release allowing him to and voluntarily giving up the right to claim him.
If for some reason you want to file as married filing separately, then either of you can claim the children or you can split them between the returns. But your taxes would be higher than if you file joint. Taxwise a step parent is treated just like a biological parent.
Your husband can't file as head of household - that's only for someone who is not married. Filing joint he'll pay less taxes anyway than if he could file as head of household.
On a joint return, if your joint income qualifies for EIC then you can get it. If you file separately, you can't get EIC no matter what your income is.
By the way, you have gotten a lot of wrong answers here. I've never figured out why people who are clueless as to tax law insist on answering questions here anyway and giving their own opinions rather than anything that's correct, but it happens regularly - I guess they must just want the 2 points or something.
But long story short, you and your husband should file a joint return and claim both kids.

If there is a court order allowing the child's biological father the child's tax exemption, then you and your spouse cannot take the exemption for the child. You would have to go back to court to get this changed.
Otherwise, your husband's stepson is treated as his own child for tax purposes. You and your spouse need to file a joint return and claim the children. You may be eligible for the Earned Income Credit based on the children.
If you are not able to claim your 3-year old because of a court order, you and your spouse may still claim the 3-year old for EIC purposes. |

The quick answer is yes, your husband can claim him as a dependent. Your son's father may be claiming him as well, which may trigger an audit, but you would have nothing to worry about since you and your husband are providing over 50% of the support. |

(my ex claims one of our children as agreed in our divorce decree)
My ex pays child support - BUT
Whether or not the father of your first child pays child support or not has no bearing in who claims the child for tax purposes.
Because your son lives with you and your current husband, he can claim all of you for tax purposes - and for EIC as well if you are within the income perameters.
UNLESS the father of your child has right to claim your son for tax purposes, via your divorce decree, or other legal device.
By the way, as I understand, anyone can claim a child as a dependent - as long as:
1) the child resides with them for over 50% of the year
2) they have provided financial support of that child (I believe there is a percentage requirement here too - but you need not worry about this, because your husband has certainly met that requirement)
and
3) no one else is claiming the child
Your husband cannot claim head of household - unless he files "married filing seperately".
There may or may not be benefit to this. Look into both options.
Federal income tax laws are national - they don't vary from state to state.
Because I am NOT a professional, I would advise you to speak to one, but I suspect that you will find this info to be true (and likely learn lots more that may be helpful in your respective situation)

Assuming that you are legally married, filing a joint return and you are the custodial parent; yes, you claim the child as a dependent on the tax return.. Even if he were paying child support, that would not give him the right of exemption for the child on his tax return.. The custodial parent claims the dependent.. Only she can give her ex the right to claim the exemption by signing a form 8332 giving the non-custodial parent the right to claim the son as a dependent on his tax filing.. You can check with the IRS, via phone or online, to get an answer from the horse's mouth.. |

Yes. If a working adult is providing at least 50% of another persons livelyhood. Your husband can claim him on his taxes and also claim himself as head of household and claim EIC. Your ex has nothing to do with this situation. Even if you were getting child support, your current can still claim all of your children on his taxes. I hope this is helpful.
