Can my mom claim me as a dependant ?
Im 20 and was a part time and a full time student last year. I still live with my mom. The only thing is i made more than my mom last year ...can she still claim me if i made more than her?

Yes she can....because you are living under her roof, she is therefore providing more than half of your support. You won't be able to claim yourself unless you pay rent, and take care of yourself entirely.

having income and providing support are not the same thing.

please read the Publication [501] and follow the logic.

irs.gov has all the Pubs online.

***
for example, if you received a student loan that you will have to pay back someday, that counts as money you spent on yourself even though you did not "earn" it.

***
counter example: if your mother owns her house free and clear and you live in it with her, she is entitled to count the fair market value of the room you live in toward support provided, even though her cash expenditure is small [taxes, insurance, utilities].

Do you even class as a dependant at the age of 20?

missmccue
she sure can....ur income will reflect on her in some situations...

That depends on what you did with your money. If you provided over half of your own support for the year, then she can't claim you - otherwise she probably can. There is a worksheet to calculate support and who paid what in several documents that you can download at irs.gov - one is Publication 17, chapter 3, page 32.

Two issues.

If you supported yourself, you can't be claimed as a dependent. Check the support test worksheet in publication 501.

Even if you didn't support yourself, if you made more than $3400, you had to be a full-time student during 5 months of 2007.

Check out the irs website for dependant information.

Marissa
Yes. Do you have a problem with her claiming you? It will help with her tax refund check.

Yup, you're living under her roof.
