I'll be 26 this March and I'm living with my mom. I go to school part time like 9-10 hours. For 2007, I've made about $13,000 (after taxes). I buy my groceries, clothes, etc. But my mom lets me live with her rent-free. Can she claim me on her tax return? And if so, does this mean that I won't get and income tax back? I also paid my tuition for last fall and this spring semester. Can't I get some of my tuition money back also? |

There are some requirements such as age and how much monetary care she provided for you.
Specifically, you do not meet the age requirements:
An individual meets the age requirement in if he:
1. Hasn't attained the age of 19 as of the close of the calendar year in which the tax year of the taxpayer begins
2. is a student who hasn't attained the age of 24 as of the close of that calendar year, or
3. is permanently and totally disabled at any time during that calendar year.
You would skip this qualification and move to qualifying relative had she paid for greater than 50% of your expenses AND you earned less than the personal exemption of 3,400.
There are tuition credits and loan interest deductions available and can be researched on www.irs.gov. If you had taxes withheld by your employer you should get money back. |

Your mom can not legally claim you as an dependent. I am not sure how it will affect you taxes but you should get money back. Just make sure that you file because you don't want to be caught. |

No she can't. You are too old to be claimed as a qualifying child, and make too much money to be claimed as a qualifying relative - those are the only two kinds of dependents.
You might be eligible for an education credit for some of your tuition and fees. |

I once took the AARP tax assistant course. What I learned was this: in your case, there are several variables which COULD apply.
They are: If she is the owner of the property and contributing at least 50% of your upkeep and/or contributing to your education costs and if/or not you could have some sort of disability or need assistance and don't forget the Earned Income Tax Credit for her doing this on a fixed/limited income. For correct assessment of this situation I would contact the local AARP tax Assistant Representative in your area. They would be most able to help you. The reason I say them is this: Since you indicated that she isn't well off or reasonably wealthy with itemizations of RR or stocks, land, gifts, etc. then they can probably be able to assist you and her with the correct filing procedure. Don't be afraid of it, it's not that complicated, they will be very helpful to you both.
But from what you've said it sounds like you're reasonably healthy, contributing to your own education and simply living at home and because of your age you'll probably just end up filing single at a higher tax rate, it's possible you could qualify for a slight break because of the level of your income was so low and you're a student. You didn't say whether or not you're working at a restaurant and earning any tips. That will be taken into account as well. Good luck. |

Well there are several ways to tell if you can be claimed as a dependent child and there is a big one showing she can't claim you...you age. Once you hit 24, even if you live with parents, they can't claim you on their taxes.
Now about getting tuition money back, there are tax credits for this, but what it means is they will give you money back that you paid in taxes up to a certain amount. I would get a 1040EZ form and plug in the numbers with your before tax amount. If you are in your first 2 years for school and no one has claimed a 'Hope credit' on you more than once, do the little worksheet. You school should send you a form saying how much you paid in tuition in 2007 and you will use it to calculate your tax credit.
Most likely you will end up getting all the income tax back that you paid in 2007. If its like me, my parents would get more money back as they had bigger incomes, and I asked them to split it with me. But thats not an option as you are over 24.
If you get too confused, most universities give free tax help to students in workshops. Take all your tax info and they can help you sort it out. Good luck! |

I don't think she can claim you as you pay your own expenses, ,But I am not sure, but if she does claim you, you can't get a refund. Be sure check out what is legal ,You wouldn't want to get in trouble with the IRS. |

If your mom were to claim you, then you cannot file for yourself. I am no expert, but I would think that your mom cannot claim you and you will need to file yourself. |

Since you are a student, mom can still claim you if she is providing for at least half of your expences. Mom will file as head of household. You can file as single - not head of household. We do our own taxes so we figure our taxes with our college sons and without. We try to find the way that will help all of us the most. If you go to the IRS website, they have free e-filing sites. They are very user friendly. The site will walk you thru the process. You don't actually file until the last step so you or mom can close out the program at any point. This is a decision that you and mom will have to work on together. |
