No, if you are 19 and not a full time student, where you live doesn't matter, she can't claim you as a qualifying child. The only way she could claim you now is if your total income for the year was under $3500 and she provided over half of your support for the year - that doesn't sound likely from your question. Go ahead and claim yourself. Tell her that you are going to - if she does claim you and you claim yourself, both of you will end up with a lot of IRS paperwork - and her claim will end up being disallowed. |

If you were not a full-time student during five months of 2008 (one semester), then your mother can claim you if
1. She provided over half of your support.
2. You had gross income less than $3,500.
Whether you live with your mother or not doesn't matter. Children do not have to live with their parents to be dependents. |

You have to live with her for at least 6 months out the tax year for her to be able to claim you. If you claim that someone can not claim you when you file your taxes and she names you as a dependant then you both can be penalized by the gov. |

If she is claiming you as a dependent, you are getting "screwed" on your taxes when you fill them out in April. One of the first questions they as on a tax form, is "Does anyone else claim you as a dependent?". When you answer yes, your deductions will drop. Sounds like mom needs to stop claiming you. If you are merely living at a different address but she is still paying for all your stuff, she should be claiming you as dependent. If not, then she should stop. |

hm... your mail goes there, but you don't live with her... I dont believe so then... she COULD, but if she got caught she'd go to jail. or... get some kind of punishment anyway. but more to the point, if you don't live with her, she can't claim you on Income Tax, i believe. |
