Can my mother in law claim my wife on her taxes?
My wife and i have been married for two years. in 2006 & 2007 my mother in law says she claimed my wife. i dont know if thats possible or true since i always wait three years to do my taxes. Can she claim my wife, and if she did will i get my tax return?

It is possible for your mother in law to claim your wife, if your wife lived with your mother in law and your mother in law provided more than half of the household income. I do not understand why you said you wait 3 years to do you taxes since taxes must be filed each year to avoid penalties. If your mother in law did claim your wife she will get the deduction if she filed her tax return before you.

She can not claim your wife. Is your mother-in-law nuts or what? When you got married that was it for your mother-in-law. Why would you wait three years to do your taxes? If you wait too long you might not get your refunds. If you owe money you will have to pay interest and penalities.

If you file a joint return with your wife (and if you have more than zero dollars in tax liability), you mother-in-law cannot claim her daughter as a dependent.

When you finally get around to filing that joint return sometime around the beginning of the next decade, the IRS will kick out a letter to your wife's mother. They will disallow the exemption on her daughter, and bill her for penalties and interest.

1. Why are you waiting 3 years to file? Do you really ENJOY giving the government an interest free loan for that long? That's just plain stupid!

2. You do not "claim" your spouse on your tax return. You may file a joint return with your spouse and you'll get 2 personal exemptions on that return.

3. If you file a joint return, your spouse's mother cannot claim her as a dependent regardless of how much support Mom provides or even if your spouse lives with her. The ONLY exception to this is if you BOTH have very low income and would have $0 tax liability if you filed separate returns.

Get off yer lazy butt and file your taxes! If you screw up and wind up owning for any of the prior years, the penalties for late filing and penalties and interest for late payment will clean your clock!

are for real????... if you are, do you have any understanding of the Tax law???.... how much you will pay in penalties?.... you need HELP... as to who can claom who... you need tax advice... if you were married in the last part of the year her parents could claim that portion where they were the main source of support... if they were.... sound fishy to me though... but YOU NEED HELP.... you are crazy if you think you will get away with that forever...

why do you wait 3 yrs to do your taxes??? - if you are due a refund, why wait for the money? if you owe tax, you will also owe penalty and interest. If MIL claimed wife - your return will definitely kick out if you also claim her. If you were married to wife in 2006 and 2007, you should win the fight , but it will take a while dealing with the IRS to clear it up and your MIL will wind up owing a lot of taxes and penalties - and you DON'T "GET A TAX RETURN" - you FILE A TAX RETURN, YOU GET A TAX REFUND - why does everyone call a refund a return??????

Do you and your wife live with your mother-in-law? If her mother is claiming her, and you do not live with her, and she (MIL) does not pay 50% of your wife's expenses, then she CANNOT claim her daughter.
You and your wife need to file MARRIED either JOINT or SEPERATE, but you also need to file on time, not 3 years later.

You haven't provided enough information to know if your wife's mother could claim her as a dependent. How old is your wife. Did she have any income? Did she live with her mother in either year?

Quit waiting three years to file your returns. It can never make sense to file late returns.
