Can my mother use my brother as a tax dependent. He is 35 yrs old and has been in jail for 5 years?
She pays any outside fees needed as well as lawyer fees used for appeal process. She pays out about $4500.00 a year.
Can any of this be written off. And is there anything else that she could do. She is also low income, about 15000/year

Sorry, but no she cannot. Your poor mother. Maybe your brother needs to grow up and handle his own problems now. He is 35 not 15.

ABSOLUTELY NOT. Attorney's fees paid in a criminal matter are not tax deductible.

If he's in jail, I'm afraid not. She doesn't support him. The state does. Fees do not constitute full support, and without fully supporting the "child," he is not a dependent of her. Sorry.

The best tax break she could give herself is to STOP paying his way. GOOD GRIEF...obviously even though he is 35 he is NOT A MAN.

no she can not. he's in jail-he's a ward of the state. she can't write any of that off---if she only makes $15000 a year, then she needs to quit paying his bills.

She would not be able to claim him, as she does not provide over half his support. Attorney fees in criminal matters are not deductible.

No, sorry, he doesn't qualify as her dependent - she isn't providing over half of his total support for the year, the county or state is, whatever jail he's in.

I have to agree with everyone else. She cannot claim him as a dependent. He's in jail and the state is providing everything he needs to live.

No. Someone who is incarcerated cannot be claimed as a dependent. None of those costs are deductible anyway so it's a moot point both ways.

At age 35 he would have to have lived in HER HOME for the entire year, among other requirements, to be her dependent. Pretty hard to do that while he's in prison!

he is not living under her roof not going to school, she needs to see and talk to a tax accouant and stop paying for his fees, he is 35 and needs to take care of himself. there are fee legal help for him. he can find this out from a public denfenders office. i told my son when he hit 25 if he was stupid enough to land in jail forget any funding, he was on his own. i would write and accept calls, but he's an adult and old enough to know better

no. i'm sorry to hear a mother paying all that money for a son as old as he is with low income. unless she has a minor child (or grandchild) that lives with her-then no.
