No. Someone who is incarcerated cannot be claimed as a dependent. None of those costs are deductible anyway so it's a moot point both ways.
At age 35 he would have to have lived in HER HOME for the entire year, among other requirements, to be her dependent. Pretty hard to do that while he's in prison! |

he is not living under her roof not going to school, she needs to see and talk to a tax accouant and stop paying for his fees, he is 35 and needs to take care of himself. there are fee legal help for him. he can find this out from a public denfenders office. i told my son when he hit 25 if he was stupid enough to land in jail forget any funding, he was on his own. i would write and accept calls, but he's an adult and old enough to know better |
