If you live with your parents for 6 months out of the year or more yes they can claim you. You will still get a return though of what you paid in last year to state and federal I believe.

Since you are a full time student they will claim you as a dependent. Since you are over 18 the kiddie tax does not apply to you.

If you provided over half of your own support for the year, then no they can't. Your proportional share of the household expenses is considered support that they provide for you.

The four tests, age, abode, relationship, and support to become a qualifing child does not consider income, where as the qualifiying relative does and you have made to much. Based on the information you have provided you have 3 of the four criteria met for the qualifing child. The support test is the only concern. So, who pays for school? Do you pay rent? What do you spend your money on? Work out the support test...which is...did your parents provide more then 50% of your support. Either way, you will still have to file taxes yourself.

Your parents can not claim you unless it cost more than $23385 to support you wich is nearly impossible.

Qualifying Children
To be claimed as a qualifying child, the person must meet four criteria:
Relationship — the person must be your child, step child, adopted child, foster child, brother or sister, or a descendant of one of these (for example, a grandchild or nephew).

Residence — for more than half the year, the person must have the same residence as you do.

Age — the person must be

under age 19 at the end of the year, or
under age 24 and a be a full-time student for at least five months out of the year, or
any age and totally and permanently disabled.
Support — the person did not provide more than half of his or her own support during the year.

Don't buy into everyone saying no. Income limitations do not apply to your children. 19 and a full time student, you are there dependent. This would be the same answer even if you were living in a dorm.

However, think about it. Your parents are probably in a higher tax bracket than you (we would hope). Your deduction is worth more to them. You are going to maximize your standard deduction because you have earned wages. We are only talking about the loss of the $3400 personal deduction which for you is $340 in taxes. However, your parents will save more than that. Show them the math and get them to toss you the $340 it cost you. They will still save a couple of $100 in taxes (even after they pay you the $340).

This is how we did it with my daughter when she was in college. Worked out well and didn't cost her a thing.
