There are two ways your dad can claim you.
Under qualifying relative rules, you'd have to make less than $3400 in 2007 and he'd have to show how he paid more than half of your total support. If your wages are more than this, no dice.
Under qualfiying child rules, the income isn't counted, and while he doesn't have to prove he supported you, he would have to show that you didn't support yourself (subtle difference) *and* yoou would have to attend school full time at least 5 months out of the year.
By the way, every time you lived with him, you were using his house for lodging. Under IRS rules, when you lived with him, your share of his costs were part of your support. Eg, his house woulc cost $2000 a month to rent and there are 3 of you, then your share--paid by him-- is at least $667 a month. You would have to show you outspent him in order to claim he didn't support you. |

The first question you need to answer is: Were you a full-time student (one semester is enough) in 2007?
If you were a full-time student, then as long as you did not provide over half of your support, and you lived with your father or in student housing for more than half the year, your father can claim you. Support includes the rental value of the furnished housing, food provided at home, etc.
If you were not a full-time student, then your father can claim you if you had less than $3,400 of income subject to tax and he provided over half of your own support.
Otherwise, he cannot claim you. |

If you didn't live with them for over half the year, then no they can't. If you weren't a full time student for some part of at least five months of the year, they can't claim you.
You say he isn't supporting you in any way - but you are living in his house. That is part of "supporting" you. There is a worksheet in several IRS publications, including chapter 3 of Publication 17. Download it at irs.gov and use it to calculate your support for the year and who paid what. Remember that any of your money that you spent on your gf or your daughter does not count as part of YOUR support.
If you lived with your parents for over half the year, were a full time student during at least five months of the year, and didn't provide over half of your own support for the year, then they can claim you.
Maybe it's time for you to move out on your own, and support yourself totally, and then this question won't come up again next year. |

Are you paying rent and utilities? Do you buy your own food and personal items? How long have you been living there? All that is taken into account. File your taxes before he does and there is nothing he can really do. |

If you aren't claiming a child I'm pretty sure that your parents can still claim you. If they are going to get more back for claiming you why not take in the extra cash flow? |
