Here are the requirements for claiming a dependent under Qualifying Relative.
1. The person cannot be your qualifying child or the qualifying child of anyone else.
2. The person either (a) must be related to you, or (b) must live with you all year as a member of your household.
3. The person's gross income for the year must be less than $3,400.
4. You must provide more than half of the person's total support for the year.
5. You cannot claim any dependents if you, or your spouse if filing jointly, could be claimed as a dependent by another taxpayer.
6. You cannot claim a married person who files a joint return as a dependent unless that joint return is only a claim for refund and there would be no tax liability for either spouse on separate returns.
7. You cannot claim a person as a dependent unless that person is a U.S. citizen, U.S. resident alien, U.S. national, or a resident of Canada or Mexico, for some part of the year. |

Your sister-in-law can claim you if
1. She provided over half of your support
2. You had income less than $3,400 subject to tax.
If the above conditions are satisfied, she can claim you as a qualifying relative. She cannot claim you as a qualifying child because the relationship test fails (you are not her child or sibling).
If she claims you, she will get one additional exemption of $3,400. She will not qualify for the Earned Income Credit, Child Tax Credit, based on your living with her.
Your sister-in-law may also claim your spouse if you were married on December 31, 2007 and the above two conditions are satisfied relative to your spouse. |

OMG! Yes, she can under certain conditions. Your gross income must be under 3,300, she must have provided more than half your total support, you must not be claimed by anyone else. But if you have income you can benefit by filing yourself and getting the earned income credit. Go to Liberty Tax, talk to them about your situation, they wont charge you for advice, or you can e-mail me if you want. |
