You are married you are never a dependent. You still are an exemption just like he is.

You and your husband can file a joint return, the fact that you aren't working doesn't stop you from agreeing to the return.

If you do not agree and have $0 in income for 2008, he can claim your exemption, but he would see the tax bill be significantly higher if you don't agree.

Your spouse could claim your personal exemption on his separate return. This does not make you a dependent, but the tax result is the same.

A better option is for you together to file a joint return, with both exemptions claimed. This results in better tax benefits for you.

No he can't, if married you can file only 1 of 2 ways, married filing jointly or married filing separately. In both cases, A spouse can not claim the other spouse as a dependant.

Spouses can never be dependents. However, filing jointly should provide him with roughly the same effect on his taxes if you had no income, IE, one additional exemption.

Also keep the tuition and fees deduction in mind. Married filing jointly is most likely your best bet regardless, but you cannot claim this deduction if you file as "married filing separately." You can take this deduction even if you don't itemize, and you can deduct up to $4,000 jointly if you paid for your education out of pocket. If you had no income, your exemption and deductions will go to waste, so you might as well let your husband reap the benefits by filing jointly.
