If they lived with him the entire year, none of them had earned income over 3,400 and he provided over half of their total support he can claim all of them as qualifying relatives.


Your wife could file married filing jointly with you and all four of
the children would be dependents because children are one of the relatives that do not have to live with you to be your qualifying children.- nor do you have to support your children for them to be your dependents. - as long as they did not provide over half of their own support. I doubt she would do this since the boyfriend is supporting her and the kids.

BTW: This is assuming your children are under the age of 19 or 24 and full time students

Whoever is taking care of more than 50% of their expenses can claim them.

If they meet the tests for qualifying relatives, he can file as single and claim their $3400 exemptions. He CANNOT file HOH, claim child care, child tax or EIC.

If the boyfriend is supply more than 1/2 of their total support, then neither you nor the mother can really complain, can you?

As long as as their social security numbers (cards) he can claim the children unless they have already been claimed on another persons return.

I would think not but the more important question is why are you letting her boyfriend live with your children? Don't you have a problem with that? I'm sure the kids do! Umm......
