Ideally you can be civil and look at the results of filing together and separately and make the best overall choice. If there is a refund, it can be deposited to more than one account if you choose direct deposit. That way neither of you has to worry about the other "stealing" their part of the refund. |

Yes, you may file as Married Filing Separately. Since you are still married, neither of you may file as Single, though.
Filing separately will usually result in both of you paying higher taxes. You also lose out on the Earned Income Credit if you file separately. That could cost you up to $4,700 in FREE money from the IRS, depending upon your income level.
Neither of you can file as Head of Household as another respondent suggests. For either of you to do so requires that you live separately for the entire last half of the year and this is not the case from what you have posted here. |

Would advise you to come together and agree on a married, filing joint tax return for the most advantagous refund possible. Disagree on everything else but agree on the money. Married, filing seperate, means there will be no EIC payment and you lose out on other credits, too. Neither can file as head of household as the IRS checks this out carefully; and if they find you lied they slap you with a ten year penalty of no EIC just for openers. Have a sit down and chart the most viable course of action. |

I ask because if push comes to shove when those children are claimed, the person with the higher AGI "wins."
Some people get the stupid idea that whoever files first gets to claim the children. It's actually a case of the children qualifying both of you. You can each claim 1, you can claim 2 or she can claim 2--and if you both AGREE, the IRS won't argue. If you can't agree, the IRS uses a tie-breaker that says higher AGI wins.
As others have said, depending on income level, you may come out best with MFJ or roughly the same with 2 MFS returns, one child each. If you were used to claiming EIC, you MUST file MFJ to get it.
If she lies and claims single or HOH, she will be audited. It's highly unlikely you have a legal "separation agreement" (which is virtually a divorce and involves alimony) since you'd know it. You were still living together into November, so HOH is out. If she claims one of those anyway, she will discover that ignoring the rules bars her from claiming EIC in the future.
(And, you may want to mention this to her, being deployed is considered a "temporary absence" by the IRS and cannot be used to justify HOH in any situation.) |

She can file for head of household if she wants to. It is her perogative. However, she will not get that much back since she only worked one month. Even with claiming two kids the tax return will not be that much. |
