My fiance and I have been living together for a year and a half now and he has taken the father role of my 20 month old daughter, so he helped me take care of her all last year and lived in the same house. Does that make him able to claim her on his taxes to get the earned income credit or whatever it is back? I worked but didnt make the amount that you shoudve made to get that big chunk of cash back for each kid. PLease help?! Whoever files Head of Household and can prove that they pay the lion's share of the bills can claim her. By your own admission, he paid the most and you didn't make much.
If he made under a certain amount even being the Head of Household, he might be eligible for the Earned Income Credit, as well. |

If he provided her support for most of the year, he could probably claim head of household filing status.
Anybody could put the SSN on their tax return and say they supported her, the question is whether or not it's true. |

Anyone can claim the child on their taxes regardless of if they are blood related or not. You just have to be able to prove, if audited or asked, that your fiance provided more than 50% of the benefit to the child. If she is living with you and your fiance, than that won't be a question. Now if she was living in someone else's home, then you might have an issue.
I was in the same situation when I was younger. I was child, not living with my parents. I was living at my friend's house because of an abusive issue that was going on in my house. The people that I stayed with where able to claim me because they were providing more than 50% of my care.
Now if the biological father is a d@#$head and claims her FIRST then it will take some time to fill an amendment and provide proof to the IRS that the child in fact lives with you and not him, and that you and your fiance pay for 50% or more of her needs. |

If you guys file jointly he can but your not married so im assuming you dont...then he couldnt...but you can if you have custody! |

He can only claim her as a dependant if she is that; a dependant.
If the biological father has provided less than 50% of support, you have the right to claim the child as a dependant. |

He needs to be able to demonstrate (prove) to he IRS that he provided more than half her financial support for the year in question.
About the only time the IRS might question this is IF someone else (say the real father) also tries to claim her in the same year.
I had this happen. The real father claimed her and my mother claimed her and me. Since we were able to prove mom paid for everything and he paid very little my mom got the decuction. |
