If two people claim the same child as a dependent on their federal income tax returns, the IRS will send both parties a letter asking both of them to drop their claim if if they aren't intitled to it. If both parties continue to assert the claim, the IRS will investigate and determine who gets the exemption. The losing party will have to pay the extra taxes plus interest and potential penalties.

Absolutely! You and the other person claiming the children can be audited to prove who had the claiming rights! And, once you are audited, look for it to happen every year!

If two people claim the same child, the person who doesn't have the right to claim them will end up having to pay back whatever they saved on their taxes, plus penalties and interest.

yes it is fraud and only the person who actually fed and took care of the children will get the right to claim them......the other person will have to return the money received with interest

No, but he can get in trouble for claiming children who are not his dependents. Whether he is the second or the first to claim them is irrelevant. If the children are his dependents, but someone else claimed them on an earlier filed return, he might have to prove the kids are his dependents.

If someone has already been claimed on the tax return, the irs already knows, and if you try to claim the same children it will be denied and you will be under investigation to find out who truely should have claimed those children. If you file your taxes and efile, the irs within 24-48 will reject the return because the social of those children have already been used.
