Can the IRS take money from my tax return If my husband owes?
My husband owes money from a business he closed but has not been able to find a job to pay it off yet. So, Can the IRS take money from my return if I file him as depemdaent? he has not worked at all this year.

Yes they can. Its the same way with child support, back taxes, and a lot of different things. If the spouse owes money it's the same as you owing the money.

You can't file a spouse as a dependent, although you can file a joint return with him and get a personal exemption for each of you.

You'll have to file an injured spouse form with your return, then they won't take your portion of the refund for his taxes. If he had no income all year AND you don't live in a community property state, you should get your entire refund if you file the injured spouse form - if you don't file it, then yes they'd take your refund.

You can't file claiming your husband as a dependent but you can opt to file a separate return instead of a joint one. If you live in a community property state, community assets, including a joint refund, can be offset to pay the liabilities of either spouse. If you live in a non-community property state, you can file an Injured Spouse claim on Form 8379 to recover your share of any refund on a joint return.

If your husband will never be able to pay what he owes, he may (emphasis on "may") be a candidate to file an offer in compromise to settle the account for less than 100 cents on the dollar. Yes, they will deducted this money. the IRS doesn't care if the debt was before you met. all they care about is there is a debt and it needs to be settled. you can also get more information from the IRS.gov website for more tax related question. but I am speaking from experience.

What state are you in? The injured spouse form works differently for community property states (if you live in California, do a joint return and he owes taxes, the form won't make a bit of difference).

If you file a married filing separately return (your *only* other choice), you can only claim his exemption if he made $0. You could still update this into a joint return before 4/15/2011.

Depends on how the business was structured (e.g. sole proprietor, llc, c-corp, etc).

If it was a sole-prop, then you are probably stuck with paying the taxes.
