Mommy2B22 | Can the IRS take my money? |
I owe money on student loans, and also have credit card fraud that I am trying to get taken care of. When it comes time for me to file my income taxes, can they keep my money for any reason to pay my debts? |

Your tax refund, if any, can be offset to pay certain federal debts, defaulted student loans and delinquent child support. |

As long as the student loans are current, they won't take money for those. But, if you are past due on federal student loans, and you have a tax refund coming, they will apply your tax refund to your student loans. If there is anything left of your return after the loans are made current, you will get that portion.
Just because you owe on the loan doesn't mean they'll take your money, I owe about $11,000 on student loans and I've never had trouble getting my tax refund, but I've always made my payments on time. |

credit card fraud is a legal issue and for that the IRS won't garnish your refund owed, but for student loans, they sure will, unitl the balance is fulfilled. |

If you have a refund or some other check coming from the IRS, they'll keep it and forward it to the student loan people to pay toward your defaulted student loans, but not if they are current or deferred. They won't get involved with credit card issues. |

yes i'm sure they can and would |

not on the credit card thing, but if student loans were govt guaranteed and you are sufficiently late/have defaulted, then they might go against your refund |

IRS is not a collection agency for various debts other than the tax debt. If you don't owe any tax bill, IRS will not come after you. But you have to make good the student loans and credit card fraud judgment. |
