Can the inland revenue demand back overpaid pension credit?
I know someone who has told the Inland Revenue they think they are being paid too much Pension Credit and have given in all their income details but they have been told it is correct. What if the IR suddenly decide they have made the wrong calculation, can they demand the money back? If so, how would they expect to be repaid? Do they have any powers to stop their pension?

yes they can ask for the money back but would deduct it from any future payments at a reasonable rate

they will not take it out of a normal pension, but will deduct it from the p. credit,for the following year

They can demand it all back and take you to court. You can appeal but it normally does not have any effect. They say they wont leave you at hardship by making the repayments as well but that is also bull. I know someone who had to remortgage because the court threats wer consistent, they wer over payed family tax credit and told the people who deal with the claims they wer but like your pal they wer told the payments wer correct. Your better off putting any money you think is not yours in a bank account a nd leaving it ther. Keep all correspondence as well and always get the full name of the person you speak to over the phone about it.

No, I had the same thing. You need to pay 25 years of contributions and after that if you pay more you can't claim it back.

Its difficult to get pension credit wrong but the Inland Revenue can and will demand back monies if mistakes are made. They may spread the money over the next full tax year.

If the UK have the same rules as the Aus. Gov. this is likely, It is hard when someone has tried to rectify it, if they want repayment, if it was me I would play safe and put what you believe the overpayment is in a savings, for a while, until you are 100% sure that you have the right information from a SENIOR person at the department concerned, and ask if it can be in writing, with the correct payments you should be receiving, with regards to your other details that you say have already been declared, because you are anxious that it should be correct for peace of mind.
The pension outlet should furnish you with written information about all your responsibilities, and rights, see if this can be supplied, and if it is a trifle confusing, ask if it can be explained to you more clearly, as these forms can seem to be a little contradictory sometimes
