 Using turbotax it says I have a $3900 refund when I only paid $900 in taxes.?

Can they garnish our taxes if?
We recently got a letter that they where garnishing 25% of my husbands checks and we were wondering since they are already taking money from his checks can they take money from our tax return also?

This debt it because of an old apartment we had and we owed 1200.00 on it but after attornys and court costs it went up to 3200.00. We didnt know we had to appear in court for it cause we didnt get a letter. but 3 weeks later we got a letter that said that the judgement for them was that they will be garnishing any source of income we have. So again my question is can they take our tax return also since there already taking 25% of our check? And IF they do take from taxes will they take the federal or the state taxes?
And is there a website i can learn about garnishments?

Possibly, but not usual to garnish tax returns for private matters.

It's not the type of debt where they can take your tax refund directly. But if you put it in your bank account, and they have that garnished, they could take it from there.

not usually because they were set up with a garnishment of wages . Now if you owe any taxes or student loan that are in default the IRS will keep any returns till satisfied

Not directly. Although, once your refund (both state and federal) is deposited in the bank, it's fair game. They can get a court order to seize any non-exempt assests to repay the debt.
You should also contact the courthouse to find out about the summons. If you were improperly served, you can request the court to vacate the judgment.

While they can't tell the IRS to send them the money, they can send your bank a levy letter. Then when you deposit the refund, they grab it.

no only government owned agencies can take your tax return. things like student loans, federal credit unions, etc.

It is not likely. The IRS is not a collection agency for private companies - only for other federal or state governments. If any of your debt is taxes or any other government debt, then yes, otherwise probably not.
