I bought a trailer home and had it put behind my parents house which is where i have been living for the past year. The problem is both myself and my mom files head of household. Is it possible for us to both file head of household this year or will one of us be able to file HOH even though we are living in two seperate dwellings. |

It will be suspicious and most likely raise a red flag, so you might expect a visit from IRS. But if you can explain to them that you have two separeta households in the same address, you might be ok. |

If your Mom has dependents (her kids) living in her home, and you have other dependents (your kids) living in yours, there should be no problems. The IRS will check to see that the social security numbers of her dependents, are different from yours. |

Since they are separate dwellings and separate households, shouldn't be a problem assuming you both meet the rules. |

Good question. The rules say that each must have a qualifying child and each must pay half the cost of keeping up the "home". "Home" is not defined, but it seems to me that if you can show that each dwelling has it's own separate expenses and you each can prove that you separately paid half the cost of each then it should fly. See IRS Pub 501, page 9 for the expenses the IRS uses to make this determination.

HOH does not have anything to do with the address. Rather, it has to do with whether or not you are providing more than half the support to a qualified tax dependent who lives with you.

Unfortunately the answer is no. Although you have there two dwellings, the address is the same. There can only be one person of the filing status head of household per address. So one of you will be able to file as head of household and the other will have to file as a single individual. |
