Can two people who live with the same child claim that child?
My boyfriend and I live together, but we aren't married, our daughter lives with us. Can we both claim her since the person who she lives with 50 percent could claim her? Since she spends all her time with both of us, how do we do this?

Only one person can claim the child. Whoever provides the most support (monetary) should claim her.

No. Only one person can claim the child. You can take turns doing it though. If you claim the child last year, he can claim the child this year. But not both at the same time.

Is this a serious relationship? If the answer is yes.. a long term relationship and you share money-
i would do taxes both ways - with the child - and see who benefits the most - and then that person should claim the child.

cli168
no. It saids on the tax form.

Shoot-em-All
only one can claim her, and the other cant. One of you can file as head of household and claim her, while the other can only file as single. Anything else is contrary to the IRS code on EIC and you would be penalized for the oversight.

One of you can claim the child as a qualifying nondependent, which will get you the child tax credit. Check H&R Block.

No you can't, but if you are married by Dec 31st, you won't have this problem again.

If you file jointly, yes. If you file separately, no.

DJ
Only one of you can claim her.

The person with the highest AGI (the total income on the first page of the 1040.) should claim the child because that will save you the most taxes if you look at the whole financial picture. Since both of you are her parents, this is what the IRS tie breaker rules would say anyway.
