What you are referring to is the AMT tax "patch". Congress jacked around with the tax code this past year until the very end instead of ceasing their meddling by Oct 1st as they should do. It takes the IRS 7 weeks after Congress quits meddling with it to reprogram their computers. Seven weeks will be Feb 11. For most taxpayers, they won't even notice as the IRS has been accepting returns since Jan 11. Only ones with problems are those who wish to claim Child Care expenses, and those with Higher Education deductions. Those items can't be filed until Feb 11th. Choices are:
1) file now without child care and higher education deductions, and after Feb 11, file an amended return for the delayed deductions.
2) don't file anything until after Feb 11th. |

If you use one of the following forms
• Form 8863, Education Credits.
• Form 5695, Residential Energy Credits.
• Form 1040A's Schedule 2, Child and Dependent Care Expenses for Form 1040A Filers.
• Form 8396, Mortgage Interest Credit and
• Form 8859, District of Columbia First-Time Homebuyer Credit.
you can’t efile until 2/11, and if you send your return by mail before that, they’ll just hold it and not process it until then. |

that is only for certain issues... one I think is for tuition or something like that... If you have a basic file then go for it.

yes you can but you cant if you are claiming any of these five credits thats what you heard on the news anyone who's claiming these credits have to wait until feb 11th due to the irs needing to update there system or something wierd like that but if your not claiming any of these then your free to file right now!
