fines and penalties can accrue but non ability to pay is not a jail offense, The government will put a lien on a persons assets and future income until money is paid but it only comes to jail if you try to defraud the IRS by not claiming all income are falsifying deductions.Filling out proper forms can usually stop the balance due to compile.

It's very unlikely that he'd go to jail over this, but the IRS might levy his bank account or seize some of his assets for not paying. His best bet is to talk to the IRS agent he'd been working with and see if he can get a little more time.

no he wont get arrested for the first offense they will probably just give him a fine

Most of the time they just keep charging you additional fines. As long as your friend keeps talking to them and paying them something. They can't get any money if they're in jail.

Your friend should really look into a good tax lawyer if they haven't already.

Yes, if it has bin that long. It may also depend on what sate you live in. You just want to call local tax professionals.

If the person is ready to pay even late he would be require to pay a fine, or a late fee only. Generally no arrest are made but if the implementation officer is adamant and is against the paying person than legally yes, he can book the person

I don't think so. My mom is paying taxes on her personal business from like 2005. She gets really stressed out about it but she does what she can and just ends up paying late fees and all kinds of bogus charges etc. It's best to get it paid on time but what can you do?

You can get arrested if you're purposely evading them but if you simply can't pay them you can just notify the IRS that you'll be late but that you intend to pay them. Fines will incur but you won't be subject to arrest or incarceration as long as you're open with them.

★Skyler Noel ★
Not a good idea. They will take that money out of your check until it's paid. You will never be able to get a loan for a car or a house. I doubt they can arrest you unless your making $ under the table and the IRS get ahold of you. Pay your taxs. It sucks but it is better in the end.

tbteddy64
You can get arrested for not paying them. They can take the money out of your wages however. But for such a small amount of money I don't see the government doing much of anything. If the government found that you cheated on your taxes you can get arrested for that, if the amount is big enough.

Well, actually yes you can be. But, will he be arrested...No!

If it was 650,000 maybe. But, even in that case if you are trying to pay it they will not arrest you.

For $650 and only one year...you will get nasty letters from a computer. And, they will withhold any refunds you have until the debt is paid.

Think about it,,,how much would it cost to arrest and house him...and how long would it take to get paid. The IRS isn't stupid...it is better to have him working so he can pay the debt.

Hope this helps.

I think he'd just get a fine. after all $650 isn't that much money really.

No...

They would have to first audit, then determine that the failure to pay was "willful" and "malicious..."

And then they would have to go through a Trial, and their peers (the jury) would have to find them guilty of tax evasion, but even then, for so little amount, they'd probably just get probabation as a worse case scenario...

I have heard that you can start worrying about jail time when you owe about $35,000 to the IRS. Don't know how true that is - but it may be a good ball park.

It is much cheaper for the IRS to go after his back account - and if he files his 2007 tax return they will take any refund - and if he qualifies for the rebate, then they will take that. But if he does not pay by April 12th they may end up adding penalties and fees to the existing bill.

he needs to call them and tell them he needs an exstenion. i think theres a penalty but i never heard anyone going to jail unless there was no taxes filed. my brother inlaw still hasnt paid his and is way over due and never locked him up for it. he just pays what hes got. good luck..

hotboysumer
well if he tells them the situlation, they will work something out with im

Chris L
he won't get arrested, but the IRS will impose penalties and interest for late payments.

the IRS has the right to directly access your accounts if you owe taxes. they may dip into your friend's bank account if there is anything there.

as not paying your taxes is illegal, this goes on your record. not good. your friend needs to pay it off asap
