Can you claim a child even if they did not live with you during the past year?
I have custody papers that say that I can claim my daughter, but she has lived with her dad for the past 20 months. Should I claim her or not?
Additional Details
I am actually the child's step mother and she lives with me and my husband and has for the past 20 months. She decided that she wanted to live here with us because she has a much better school, home life and church life. Her mother claimed her on her taxes this year and we are not sure what to do about it. She does not pay any child support and we pay for her travel to see her mother. She pays nothing other than 1/2 of her medical expenses. Should we report her or just let her have the tax credit... even though she lied to get it???

You need to be very careful with this, you do not want to get in any trouble with the IRS. I have heard that people do this all the time, claim kids that are not with them, but it can come back and bite you in the butt. You are not supposed to claim a child if they did not live with you at least 6 months out of the year.

What you need to do is ask her father if he is going to claim her, if not then I guess you could. But again be careful because if for any reason he wants to later on say you were lying, you could get in a lot of trouble.

If you can prove you you paid for 51% of her care.

If you have legal documents that say you can claim her, then that should settle any questions. Claiming her is your legal right according to court records.

I really hate it when someone coyly posts a question and then says that their situation is really the opposite side.

The current version of the IRS publication 501 goes by actual PHYSICAL custody. If you can show this, then just have your husband claim the child anyway, file on paper and let the IRS resolve the duplicate. As a non-custodial parent, the mom didn't have the right to claim HOH or EIC.

If the custody papers give you the right to claim your child for odd or even years and this is your year, then yes you could claim her..

As long as her father is not going to claim her, you can claim her.

Scroll down to the section titled "Children of divorced or separated parents."

Then, see if you still need professional guidance.

You can ONLY claim her if YOU were the primary caregiver for that child. It all comes down to that. If you're in doubt about it, I'd consult a tax attorney.

She's a child, not a possession, you should ask for custody of your daughter, but only if you want her and will take care of her. If neither of you wants your daughter, then please put her up for adoption so people who will love and take care of her can do so.
