My mother in law said that her daughter does this and she should know because she has a ton of kids (she is married and Mormon...will pop them out until she can no longer). Don't you have to have a social securtity number to claim a child on your tax return? The reason my MIL told me this is because I am due January 28th. She said you can claim them before they are born because you are already paying medical bills and such to have the child. I just want to knwo if this is true or not? This never came up with my daughter because we had her in December. |

Your motherinlaw is wrong...and her daughter is going to find out eventually from the IRS that she is taking illegal deductions. You cannot deduct anything except your medical expenses (IF you itemize) until the baby is born. Unfortunately, if the baby is born at 1 minute past midnite Jan. 1, it cannot be claimed for the previous year. Born 1 minute BEFORE midnite and it can be-for a larger deduction that year. Yes, you need a social security number. Once your baby is born, when you file for 2008 (the year you say you are due) the deduction is for the entire year. You will not be able to 'deduct' for 2007.
Check with any H&R Block tax agency or go on-line to the IRS tax site and you will find this out fast.
For whatever reason your motherinlaw 'thinks' that 'she should know because she has a ton of kids' shows her ignorance. Falsely claiming dependants can cost her a lot of penalties! |

No, you cannot claim a child for any year prior to the year of birth. If the child is stillborn or you have a miscarriage or abortion, you cannot claim the child for any year. If the child is born and then dies, you can claim the child for the entire year in which it was born (and the entire year in which it dies, if different), even if it is was alive for only one second of that year.
In all cases, you can claim the medical bills on Schedule A as an itemized (medical expense) deduction. |
