Yes, you may claim your grandchildren on your tax return. You will not qualify for the Earned Income Credit due to the fact that the children do not live with you. You will be able to receive the deductions for the kids and possibly an additional $300/per child for the Economic Stimulus Payment/ Rebate Check. The answers that say you can claim the children are incorrect.
The grandchildren live with their mother. Since they do not live with you, they cannot be your qualifying children. Since they are qualifying children of the mother (and father if he lives with the children), the children cannot be your qualifying relatives. So, under current rules, you cannot claim your grandchildren even if you support them.
However, if your daughter is unmarried, earned less than $3,400 in 2007, and you provided over half of her support, then you could claim your daughter even if she did not live with you. If you claimed your daughter, she could not claim her children, but the father could. |

No, since they don't live with you, the grandchildren can't be claimed as qualifying children, and since they DO live with their mom, you can't claim them as qualifying relatives - those are the only way to claim dependents. |

A grandchild does not necessarily have to live with grandparents to qualify as a dependent. However, they cannot be the "qualified child" of someone else. And from what I see in your story, they are the qualified child of their mother (even if she doesn't provide more than half their support).
See Table 3-1 in IRS Publication 17. Look at the left column...the kicker (and it wasn't always this way) is:
"The child must not have provided more than half of his or her own support for the year. "

Visit www.irs.gov. This is the IRS web site. Then look at Publication 17 for Dependents. There are 5 tests that you must meet to claim any dependent. Yes, you can claim your grand children if you meet all 5 test. The test you are asking about is the support test. You have to be able to verify that you paid more than 50 percent of the childrens support for 2007. Also, a good idea to check if your daughter or her boy friend claimed the children on either of their returns.
If your daughter or her boy friend are paying the rent where they live, then it will be very hard for you to verify that you paid more in support than they did just by them paying the rent. |

I think it says that if you pay 1/2 of the childerns need and have them in house for 6 months out of the year you can however i think it is a consent between you and your daughter?Good luck hope this helps somehow? |
