If you are entitled to claim the child, you can do so even without her permission. If you are not entitled to claim the child, you cannot do so even with her permission. The only time that permission affects whether a person can claim a child is if they are a divorced or separated parent of a child that could be claimed by the other parent if that parent did not give permission. Even that exception requires a very specific form, not just an oral ok.

That depends. If the child lived with you for over half the year, and nobody else like a parent is claiming her, since she's your niece you could claim her. But if she didn't live with you for over half the year, no you can't legally claim her, and yes you can get in trouble if you do.

Yes, you can and she can get in trouble.

Because the 3 year old is the "Qualifying Child" of your sister, you can not claim her unless she lived with you for over 6 months in 2007.

The IRS looks very closing at people claiming "neices" and "nephews" on their return.

There are 2 circumstances in which people can merely agree to have one claim the child. The first is for divorced or separated parents, so that wouldn't apply to you.

The second way is if the child meets the definitiion of a qualifying child (QC) for both you and your sister, and you cannot be claimed on anyone else's return, the 2 of you can choose who will get the exemption.

That would be very handy if your sister has high income and phases out on exemptions. You could then claim the child, get the exemption, and possibly even qualify for the EIC.

There are only two legal ways to claim this child.

1. If he/she lived with you more than 6 months out of the year, he/she's your sister's child (blood relation) and he/she didn't provide his/her own support, then she can be your qualifying child. (If he/she is the qualifying child of more than one taxpayer, then you can agree as to who claims him/her.)

2. If the child did NOT live with you, then you must meet the following tests to claim the child as a "qualifying relative."

--Must NOT be a qualifying child of someone else, even if they don't claim them.
--Must be a blood relative.
--You must have provided more than 1/2 of their support (or in the case of 2 aunt's/uncle's paying support, a signed multiple support agreement).

A qualifying relative does NOT entitle you to HOH, child care credit, child tax credit OR the EIC.

Be absolutely sure that you understand how you are claiming this child (she can't just loan you a dependent). If the IRS questions you, you will provide the proof that you met these tests. If you can't, not only will have to pay any erroneous refund back with interest and penalties, you can be BANNED from the EIC program for 10 years for disregarding the rules.
