To claim a baby, it must be born alive within the tax year.
In utero never counts. (Legally it's not a baby yet, it's a fetus.) |

You cannot claim the child until the child is born. AND you MUST get a social security number for the child in order to claim them.
If the child is due in 2008, you can claim the baby for 2008....but, not 2007, unless the child was born on December 31 or earlier. |

You'll get the SSN while you're still in the hospital having the baby, they fill out the paperwork there for it. It doesn't matter what month the baby's born in, as soon as you have him/her, you'll be able to claim them for that full year - if you're pregnant right now, you won't be able to claim for the year 2007, but you will be able to for 2008. |

No, the baby has to be born even for a moment. Personal exemptions for 2007 taxes are $3,400 each. Personal exemptions for 2008 taxes will be $3,500 each. |

The IRs states the child must of been alive for at least 1 minute in the year to be claimed. |

You cannot claim an unborn fetus on your taxes. Even if the baby is born before you file, you cannot claim it unless it was born before the end of the tax year for which you are filing.
However, if you are pregnant and have another baby that was born last year or earlier, you can claim the baby that was born (for the year of birth and subsequent years), just not the fetus. |
