I am assuming that you are referring to getting a tax return - unless there is a court order and your ex has not yet filed it with the federal government they can not and will not flag/hold your federal income taxes. State taxes are a different animal - most states can and do with hold state refunds if you are in arrears (generally 12 or more weeks) - if you are remarried and filing jointly you must have your spouse file as an injured party - this means the government can only take half of the expected return and the remainder is determined to be the new spouses property - check with your lawyer or department of revenue in your state for details - they generally can let you know if your account has been flagged to be intercepted. |

no tax return if you owe back child support.
Be there, done that.
Best thing to do is get your support caught up.
Good luck |

however much you owe they will take it out! and it dont matter if that is all of the taxes they will take all of it!! but it depends on how much you owe! past experience.. (not me) |

nope-if u owe support, then the IRS gives it to the one that has custody. It doesn't matter if it was agreed in divorce decree for every other year- wimpy never got his hamburger on wednesday if he didn't pay friday through tuesday.
For god sakes- this is why if you don't want to have to support the flesh that comes from your loins from being irresponsible then be responsible put something more apropriate on. So you don't end up thinking your getting screwed from screwing. |

no, they take your refund and give it to the mother |

If you are behind in paying child support, any refund you have coming will most likely be taken to help you catch up. If your refund is bigger than what you owe, then only the amount you owe will be taken, and you will get the rest. |

If you are supposed to get a return, the govt will take it. Happened to someone I know for years. |

you can file, but if you get anything back....it will definitely go to that child / mother. That's how we do it in the Lone Star State. |

If you mean a tax refund you will be subject to a withholding by most government agencies for the support owed. also your wages are subject to deduction for amount owed.
Step up to your responsibility and be faithful to your children. |

Ms. Angel..

Are you asking if "when you file your tax return" and you are due a refund will you get the refund, no if the Attorney General has already requested the refund to go to them then it will go to your child(ren) for them to be able to eat decent foods, dress and have warm coats for the winter. and to help pay to have a roof over their heads. |

I still have a child at home that i have not got a dime of child support on. And i have a child i pay child support on. I would like to know why my income tax was not divided between the two instead of being given to the one. |
