Yes you can, as long as you didn't live together even one day after June 30, and you provide over half of the expenses for keeping up a home for your children who live with you. He'll have to file as married filing separately. |

If you have lived apart from you spouse for the last six months of 2007, you have a dependent child who lived in your home, and you paid for over half of the cost of maintaining the home, then you can file as head of household.
If you do not qualify to file as head of household, in order to get the EIC you will have to file a joint return with your spouse. Your only other filing option is married filing separate, which disqualifies you from EIC. |

I agree with others, you should ask an expert. Especially since the laws in Canada and the US are different. And the IRS has a bad track record of giving wrong information on the telephone. It appears that other people are right, though, you should be able to claim as head of household. |

You can only claim Head of Household if you have dependent children. But only if you have custody and no one else can claim them.
Your husband has no right to claim than unless he adopted them , then you might have a problem, otherwise you can claim both earned income credit and head of household. |
